We recently advised the Bayonne (NJ) Municipal utilities Authority (BMUA) in undertaking a procurement for a public private partnership of its water and sewer system. A public procurement process was implemented under state law and bidders were vetted as to their abilities and their economic proposals. In the end BMUA needed to evaluate a pure operating agreement or a true concession agreement and determine not only the economic results but also the impacts on ratepayers over time.
